2. Scope

These Terms apply to:

• All visitors and users of the website

• All clients purchasing or booking services

• Any product or media delivered by Immobilien Media

By accessing the website or engaging in services, you acknowledge acceptance of these Terms.

3. Services Provided

Immobilien Media offers the following professional services:

• Real estate photography

• Real estate videography

• Virtual tours & 360° photography

• Drone photography (where legally permitted)

• Editing and post-production

• Delivery of media files

• Optional printed photo products

Service descriptions, packages, timelines, and prices may vary and will be communicated individually.

4. Contract Formation

A contract is formed when:

• A written quote is accepted by the client

• A booking is confirmed through Calendly or email

• Payment terms are agreed in writing

• The client accepts a service proposal

Verbal agreements may be valid but must be confirmed in writing for clarity.

5. Pricing & Payment Terms

• All prices are provided in Euro (€).

• Pricing shown on the website or calculators is non-binding until confirmed in writing.

• Payment is due within 14 days of invoice unless otherwise agreed.

• Late payments may incur statutory late fees according to § 288 BGB.

• Invoices are delivered electronically unless requested otherwise.

6. Cancellation & Rescheduling

6.1 Client-side Cancellation

• Cancellations made less than 24 hours before the scheduled appointment may incur a cancellation fee.

• Deposits (if applicable) are non-refundable after project confirmation unless otherwise negotiated.

6.2 Weather Conditions

• Outdoor shoots may be postponed due to weather at the discretion of the photographer.

• No penalty applies for weather-related rescheduling.

6.3 Photographer Cancellation

• In rare cases of illness or unforeseen emergency, Immobilien Media may reschedule or provide an alternative photographer when possible.

7. Delivery of Media

• Standard delivery timeframe is communicated in the project agreement (usually 3–7 business days).

• Media is delivered via secure cloud storage or file-sharing services.

• The client is responsible for downloading and backing up final media files.

• Raw files are not provided, unless explicitly agreed and subject to additional fees.

8. Revisions

• Each project includes one round of standard revisions unless otherwise agreed.

• Additional revisions may incur extra charges based on hourly or per-image rates.

9. Copyright & Usage Rights

9.1 Ownership

All photographs, videos, and media files remain copyrighted to Immobilien Media unless explicitly transferred in writing.

9.2 Client Usage License

Clients receive a non-exclusive, non-transferable license to use media for:

• Real estate listings

• Marketing of the property

• Commercial property promotion

The license does not allow:

• Resale of media

• Transfer of media to third parties without consent

• Unauthorized editing, filtering, or alteration

9.3 Photographer Portfolio Usage

Media may only be used in the photographer’s portfolio or marketing with the client’s explicit written consent, per GDPR.

10. Liability

• Immobilien Media is liable only for damages resulting from intentional misconduct or gross negligence.

• No liability is accepted for delays caused by technical issues outside the photographer’s control (e.g., Cloudflare outages, DreamHost server failures).

• Sensor dust, minor lighting imperfections, or environmental conditions are not grounds for refund unless significantly impacting quality.

• Drone services are subject to legal and flight safety restrictions—no liability for denied flight permissions.

11. Website Use & Conduct

Users agree not to:

• Attempt to breach website security

• Use scraping tools or bots

• Interfere with website functionality

• Upload malicious files or code

Violations may result in access blocking or legal action.

12. Third-Party Service Integrations

Your interaction with certain parts of the site may involve third-party tools including:

• Calendly

• ConvertCalculator

• Google Analytics

• Microsoft Clarity

• LogRocket

• Cloudflare

These services operate under their own terms and privacy policies.

13. Intellectual Property (Website)

Immobilian Media reserves the right to terminate an ongoing project if:

• The client behaves abusively

Fees for completed work remain due.

These Terms are governed by:

• Jurisdiction: Berlin, Germany

Any legal disputes will be handled by courts located in Berlin.
